According to clause 5.26 of the National Standard DSTU 4163:2020 “State Unified System of Documentation. Unified System of Organizational and Administrative Documentation. Requirements for Document Execution”, approved by order of the State Enterprise “Ukrainian Research and Training Center for Standardization, Certification and Quality Problems” dated 01.07.2020 No. 144, which entered into force on September 1, 2021, the mark on certification of a copy of a document consists of the following elements: the words “” (without quotation marks), the title of the position, the personal signature of the person certifying the copy, his or her own name and surname, the date of certification of the copy.
A similar legal position is set out in the resolutions of the Supreme Court dated 12/18/2018 in special database case No. 761/5894/17 , dated 05/08/2019 in case No. 160/7887/18 , dated 06/01/2021 in case No. 640/6758/20 , dated 07/01/2021 in case No. 750/5843/19 , dated 06/01/2021 in case No. 640/6758/20 .
In the context of the aforementioned legal conclusions, this method of certification can be recognized as acceptable only for copies of materials attached to procedural documents, but not for the rules for the execution of a procedural document.
At the same time, the requirements for procedural documents and annexes to them are determined by the procedural law , and not by the National Standard of Ukraine dated April 7, 2003 No. 55 DSTU 4163-2003, approved by the State Committee for Technical Regulation and Consumer Policy. The rules for affixing a mark on the certification of a copy of a document, specified in clause 5.27 of DSTU 4163-2003,
